PROBLEM: Since New Mexico law expressly prohibits sending out blank ballots to voters who have not requested them, the Secretary of State instead is sending out absentee applications.

  • New Mexico statute 1-6-5I, amended in 2018, made it illegal to send an absentee ballot to anyone other than someone who requested it.
     

  • In 2020, the Secretary of State and several county auditors challenged this law in court for the right to send every registered voter in New Mexico a blank ballot in an all-mail June primary

  • The Supreme Court ruled unanimously that they could not do this without legislative input, and instead, the Secretary and auditors sent out absentee ballot applications to every registered voter for the June primary. Even this compromise measure has been a heavier weight on the bureaucratic systems than leaders expected.
     

  • No decisions have been finalized yet on procedures for the November general election
